An Update on Finding Chloe

Six months after the family judge decision, on October 7th, 2008 my appeal to the family judge was denied, Chloe needs to stay in Mexico.

On October 28th 2008 I filed an ”Amparo”. I am appealing the family judge decision in the Mexican federal court.

A Federal judge was assigned to Chloe’s case mid November 2008.

In March 2009 the Federal judge overruled the family judge decision and ordered the return of Chloe to the USA as soon as possible.

This decision was appealed by the kidnapper to the Mexican Supreme Court.

In June 2009 the Mexican Supreme Court made its final verdict. They ordered the return of Chloe to the USA.

“…la sala revoque la resolucion de primera instancia y conceda la restitucion de la menor Chloe Combe Rivas al domicilio que tenia antes de su traslado ilicito a esta ciudad, para lo cual debera tomar las medidas adecuadas para garantizar dicha restitucion, en forma immediate, y en las mejores condiciones para la menor.”

“…the court revokes the resolution made in first instance and grants the return of the minor Chloe Combe Rivas to the domicile that she had before her illegal transfer to this city (Mexico City), adequate measures will have to be taken to guarantee the above mention restitution, in immediate form and in the best condition for the minor.”

I have been working for three agonizing years to finally be able to read that sentence.

This decision will help future cases of parental kidnapping in Mexico to be resolved.

Thank you for all involved in that result.

BUT,

Chloe was ordered to be returned to the USA by the Mexican Supreme court on June 2009, and still Chloe is not back home. The kidnapper has been hiding Chloe from US law and now Mexican law since June 2009.

Has there been a extradition request? I think recently Mexico has been responding quickly to those requests.

And if youhave such a recent order, why not just go there and grab her? (if you know where she acutally is)

Firstly, to answer Trent, Mexico will not extradite their own Nationals. So that is not an option.

Secondly, it is against the law to *go there and grab her* in Mexico. The father could end up in jail.

To suggest to the father... it may be helpful to post the birthdate of your child so that people have an idea of her age. I am in Mexico City and see blond little girls all the time. There is a massive community of expats here.

Have you asked the government to do a school search. She needs a birth certificate to enter school here, and her name has to be somewhere in a system here.

Also, what kind of background or work does the mother do. What is her education. Is her English good. Etc. Those are the things that the general public, if they new, could help with.

Just some things to consider.

Perhaps Chloe might come home on her own? I mean her mother seems to be one step ahead of the police, the FBI, and Mexican Police.
Does anyone know if Aline has any family in Mexico? I mean aside from her mother and twin brother?
